The terms between you and SharkSale when you use our website, Discord bot, or paid plans.
These Terms of Service ("Terms") govern your access to and use of the SharkSale website at sharksale.pro, the SharkSale Discord bot, and any related services (collectively, the "Service"), provided by SharkSale ("SharkSale," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
You must be at least 13 years old (or 16 in the EU) to use the Service. If you are using SharkSale on behalf of a company or team, you represent that you have authority to bind that entity to these Terms.
You access SharkSale through your Discord identity. You are responsible for everything that happens under your Discord account inside SharkSale, including your subscription status, your training sessions, and your conduct in any shared SharkSale spaces.
SharkSale provides AI-powered voice sales training inside Discord. The AI buyer, scoring, coaching, and certificates are simulated training tools. They are not investment advice, employment endorsements, professional certifications, or guarantees of real-world sales results. Use the product the way you would use a flight simulator: real practice, not real money on the line.

During a SharkSale session your microphone audio is captured, transcribed, and analyzed. See our Privacy Policy for details. You grant SharkSale a limited license to process your audio, transcripts, and inputs solely to operate the Service for you. You retain ownership of your own underlying inputs.
If you purchase a Custom Voice add-on, you represent that you own the rights to the audio sample you submit (or have explicit written permission from the speaker). SharkSale may refuse, remove, or revoke any custom voice that violates a third party's rights or our policies.
The AI buyer, scoring, coaching reports, and certificates are generated by machine-learning systems and can be wrong, biased, or absurd. They are tools, not truth. Always apply human judgment before relying on any output in a real sales situation.
The SharkSale name, logos, marks, website design, and all underlying software are owned by SharkSale and protected by U.S. and international intellectual property laws. Nothing in these Terms grants you any right to use our brand without prior written consent, except as necessary to describe that you use the Service.
You may stop using SharkSale at any time. We may suspend or terminate your access if you violate these Terms, abuse the Service, or pose a risk to other users. We will make reasonable efforts to notify you and to refund any unused prepaid time on a paid plan if termination is not for cause.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHARKSALE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO SHARKSALE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR $100, WHICHEVER IS GREATER.
You agree to indemnify and hold SharkSale, its founders, employees, and agents harmless from any claim or demand, including reasonable attorneys' fees, arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, for any dispute that is not subject to informal resolution or any required arbitration.
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date and, where appropriate, an announcement in the SharkSale Discord. Continued use of the Service after the changes take effect constitutes acceptance.
